Waiver of the Right of Withdrawal

1. Why this page exists

Daway is a US company and is not governed by French law or by the law of the European Union; it nonetheless takes them into account. As a matter of policy, and where the mandatory law of the consumer's country of residence so provides, a 14-day right of withdrawal may apply to certain purchases. Because our content is made available immediately, this period may be lost if the User expressly requests immediate provision and waives it.

2. The 14-day right of withdrawal

Where it applies, this right allows a consumer to withdraw from a distance contract within 14 calendar days, without reason or fees. For services and digital content, the starting point is the contract conclusion date (payment validated).

3. Why we ask for waiver

Daway and its Creators provide immediately-executed digital content (instant community access, course unlock, exclusive content). To grant access as of payment, we ask for the User's express prior agreement to lose the withdrawal right. Depending on the product, the Creator may enable or require this waiver.

4. Consequences of the waiver

By ticking the box at payment, the User acknowledges: (1) requesting immediate provision before the end of the applicable period, (2) losing the withdrawal right as of payment validation, (3) no longer being entitled to an automatic refund as of right. Any other applicable rights (for example an applicable warranty of conformity) are not affected.

5. Validity conditions

Three cumulative conditions: (1) express prior agreement — unchecked by default, actively ticked by the User, (2) express renunciation — clear and unambiguous wording, (3) durable medium confirmation — automatic payment receipt + a mention retained in the User's Daway profile ("Waiver accepted on [date]").

6. How to decline

The User is not required to accept. If the box is not ticked where it is required, the purchase cannot be finalised for immediate-execution content. Contact contact@daway.club for any available alternative (deferred payment, scheduled access).
